Washington State has Tough DUI Laws
Drunk driving is illegal in Washington. The state has some of the toughest and most comprehensive DUI laws in the country. According to data from the Washington Traffic Safety Commission (WTSC), approximately 25,000 intoxicated drivers are arrested by state or local law enforcement each year. Under Washington law (RCW 46.61.502), a motorist can be arrested and charged with a criminal DUI offense if they have a blood alcohol level of 0.08 or higher, a THC concentration of 5.00 or higher, or are otherwise unlawfully under the influence of alcohol or drugs.
An Overview of DUI Penalties in Washington
In Washington State, a DUI is classified as a gross misdemeanor offense. The penalties for a conviction will depend on several factors, including a motorist’s prior history of intoxicated driving or their lack of a criminal record. Here is an overview of DUI penalties in Washington:
First-time DUI offense: Maximum penalties of 364 days in jail and a $5,000 fine, with a minimum mandatory jail sentence of at least 24 hours or 15 days of home monitoring.
Second-time DUI offense: Maximum penalties of one year in jail and a $5,000 fine, with a minimum mandatory jail sentence of at least 30 days.
It should be noted that there are other adverse consequences that come with a DUI conviction as well. Your license could be suspended or revoked, you may be required to install an interlock ignition device on your vehicle (at cost), and you will face increased auto insurance premiums.
